Description of Services
General
Onmode is an AI-powered nutrition coach. Our coach, Oni, helps you log meals from a photo, your voice or a short description, estimates calories and macros, and helps you keep habits such as an eating window, water intake and medication days. Some features may not always be available, and we reserve the right to change, update, or discontinue them at any time. To use the Services you create a personal account with Sign in with Apple, Google, or a one-time code sent to your email address (your “Account”). Onmode may change the functionality of the Services and introduce or change prices and fees at any time, in its sole discretion.
Logging your food
You may submit a photo, a voice note or a text description of a meal. Our AI analyzes it and returns an estimate that may include detected items, estimated calories and macros, coaching feedback, and other information our models identify (the “Analysis”). Estimates are generated by AI and are approximate (see the Disclaimer of Warranties).
Oni, your coach
The Services include an AI coach that comments on your meals, replies to you in chat and in voice conversations you start, and suggests targets, recipes and next steps. Oni is informational and motivational only and is not professional, medical, dietary, or health advice.
Trackers
You can track an eating window (intermittent fasting), water, workouts, weight, and the doses of a medication you take, such as a GLP-1 medication. Medication tracking is a log and a reminder only: Onmode records what you tell it and never recommends, sets, or changes a dose. Always follow your prescriber’s instructions.
Your profile
Within the App you can review your meal history, track your daily targets and progress, and edit your profile, goals, and preferences so the Services stay tailored to your needs.
Export and share
You may export or share content you create in the App through the functionality provided. If you choose to share content, you understand it may become visible to others.
Scope of the Services
Onmode reserves the right to change the functionality of the Services and to change or introduce prices and fees applicable to the Services at any time, for any reason, in its sole discretion and without prior notice.
Who Can Use the Services
You must be at least 16 years of age (or such other minimum age at which you can provide consent to data processing under the laws of your residence) and not otherwise barred from using the Services under applicable law. You must provide accurate, complete, and current Account information and keep it up to date; if you do not, we may suspend or terminate your Account. Keep your Account details confidential, notify us immediately of any unauthorized use, and accept that you are responsible for all activity under your Account.
Onmode Content
Our intellectual property
The Services and Onmode’s proprietary text, graphics, images, illustrations, characters (including Oni), trademarks, trade names, icons, scripts, and other content (“Our Content”) are owned by us or our affiliates and are protected by copyright, trademark, trade secret, and other intellectual property laws. Except as expressly stated in these Terms, we reserve all rights in and to the Services.
License
If you comply with these Terms, we grant you a limited, worldwide, royalty-free, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services solely for your own personal, non-commercial purposes.
Use restrictions
Except as expressly permitted, you may not: (a) sell or commercially exploit any part of the Services; (b) copy, reproduce, distribute, publicly perform, or publicly display any part of the Services; (c) modify or create derivative works, including removing proprietary notices; (d) reverse engineer, decompile, disassemble, or attempt to extract the source code (unless applicable law permits); (e) distribute, transfer, sublicense, lease, lend, or rent the Services to any third party; or (f) use the Services other than as expressly provided in these Terms.
Third-party and open data sources
Some ingredient and nutritional information may be derived from third-party and open datasets, including data made available under the Open Database License (ODbL) and data from Open Food Facts (© Open Food Facts contributors, world.openfoodfacts.org). Such third-party data is provided for general informational purposes only, may include estimates or AI-generated values, and remains subject to the licenses under which it is made available.
User Content
Content you submit or make available through the Services, including meal photos, voice notes, descriptions, messages to Oni, and other content (“User Content”), remains yours. We do not claim ownership of your User Content.
By making User Content available through the Services, you grant Onmode and its affiliates a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, copy, modify, create derivative works from, distribute, and display your User Content in connection with operating and improving the Services, including using it in a de-identified manner to evaluate and improve the quality of our estimates and coaching.
You represent and warrant that you have all rights necessary to grant this license, and that your User Content and our use of it will not infringe or violate any third party’s intellectual-property, publicity, or privacy rights or any applicable law.
You are solely responsible for your User Content. You can remove it by deleting it; note that residual copies may persist for a period in backups or where required by law. To the maximum extent permitted by law, we are not responsible for the removal of, or failure to remove, any User Content.
Prohibited Conduct and Content
Onmode is built to help people improve their eating habits with respect and care. You agree not to:
- harass, bully, or demean others, or judge anyone by race, gender, religion, body, health, or other personal attributes;
- upload anything other than food and meal content and related material: no illegal content, violence, nudity, or other adult content;
- post content that promotes unsafe eating practices, dangerously low-calorie intake, or eating disorders (for example anorexia, bulimia, or self-starvation);
- use the Services to violate any law or third-party right, or to interfere with, overload, or disrupt the Services.
We may issue warnings, remove content, and suspend or terminate Accounts for violations, at our sole discretion. Please report content that violates these Terms through the contact form or at hello@onmode.fit.
Monitoring of Content
We are not obligated to monitor the Services, but we may do so to operate them, enforce these Terms, and comply with law. We may remove, at any time and without notice, any content we find to violate these Terms or that we otherwise consider objectionable, and we may cooperate with law enforcement.
Feedback
If you send us feedback, comments, or suggestions, you grant us an irrevocable, perpetual, worldwide, royalty-free, sublicensable, and transferable license to use them without obligation to compensate you, attribute you, or act on them, and without any duty to treat them as confidential.
Fees and Payments
General
Certain features (“Pro features”) require a paid subscription (“Subscription”). Subscriptions bought in the App are purchased through the Apple App Store and processed by Apple. Where we offer purchases on our website, payments are processed by our payment processor, Stripe. When you purchase a Subscription, you authorize the charge of the applicable fee, plus any taxes, to your payment method. You represent that you may lawfully use the payment method provided. Except as expressly stated in these Terms or required by applicable law, all payments are non-refundable and non-transferable.
Subscriptions auto-renew
By purchasing a Subscription, you authorize recurring charges. Your Subscription renews automatically at the then-current price and interval shown at purchase until you cancel. A free or paid trial (where offered) automatically converts to a recurring Subscription at the full price when the trial ends, unless you cancel at least 24 hours before it ends.
Cancelling your Subscription
You can cancel at any time. Cancellation takes effect at the end of the then-current billing period: you keep access until then, and you will not receive a refund for the current period. We do not offer a general money-back guarantee, but see “Refunds” below for charges made by mistake. Deleting the App does not cancel your Subscription.
- iPhone and iPad (App Store): Settings → your name → Subscriptions → Onmode → Cancel Subscription. Refunds for App Store purchases are handled by Apple under Apple’s policies; we do not control them.
- Website purchases (where offered): email hello@onmode.fit or use the contact form. Website purchases are non-refundable except as described under “Refunds” below or where a refund is required by applicable law (for example, statutory withdrawal or “cooling-off” rights where they apply).
Refunds
If you started a trial or Subscription by accident on a purchase made directly with us, contact us at hello@onmode.fit and we will fully refund the charge. So we can locate your subscription, we may ask for the email address the subscription was made with and the last 4 digits of the payment card used (never share the full card number). We respond to refund requests usually within 2 business days, and always within 5 to 7 business days. Approved refunds typically appear on your card within 10 days, depending on your bank. Refunds for purchases made through the Apple App Store are decided by Apple under its own policies; we are happy to help you request one.

Copyright Complaints
If you believe content on the Services infringes your copyright, send a notice under 17 U.S.C. § 512(c) of the DMCA to hello@onmode.fit (or by mail to Seebit Interactive Agency SRL, Str. Infratirii nr. 6, Targu Mures, Romania) including: identification of the copyrighted work; identification and location of the allegedly infringing material; your contact information; a good-faith-belief statement; a statement that the information is accurate and, under penalty of perjury, that you are authorized to act for the copyright owner; and your signature. We may, in appropriate circumstances, terminate the Accounts of repeat infringers.
Indemnification
You agree to indemnify and hold harmless Onmode and its officers, directors, employees, agents, and affiliates from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or connected with (a) your use of the Services, (b) your User Content, or (c) your violation of these Terms.
Privacy
We process personal information as described in our Privacy Notice. Please review it to understand how we collect, use, and share your information. You can export your data or delete your Account from inside the App (Settings → Privacy & data), or email hello@onmode.fit for help.
Disclaimer of Warranties
The Services are provided “as is” and “as available,” without warranty of any kind. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or that any information will be accurate, complete, or reliable. Your use of the Services is at your own risk.
Onmode is for informational and educational purposes only and is not a substitute for professional medical, nutritional, or dietary advice, diagnosis, or treatment. Onmode is not a medical device, we are not a medical organization, and using the Services creates no physician-patient relationship. Consult a qualified healthcare professional before starting any diet, fasting, or exercise program, before changing anything about a medication, or if you have any health concern, are pregnant or breastfeeding, are under 18, or have or have had an eating disorder. You are solely responsible for understanding your allergies, sensitivities, and health conditions.
Generative AI is an evolving technology and can produce unpredictable or inaccurate results. Calorie and nutrition estimates are approximate and may be wrong, and Oni can make mistakes. Always double-check information and consult a professional before relying on it. If you encounter an estimate or a reply you believe is harmful or false, report it through the contact form or at hello@onmode.fit. If you are in distress or think you may have a medical emergency, contact your doctor or local emergency services.
Your Representations and Warranties
You represent and warrant that: (a) you are at least 16 (or the age of majority where you live) and can enter into these Terms; (b) your use complies with all applicable laws; (c) your User Content does not infringe third-party rights or violate any law; (d) you will not upload harmful, harassing, defamatory, obscene, or otherwise objectionable content; (e) all information you provide is true, accurate, complete, and current; and (f) you will not misuse the Services in any way that could damage, disable, overburden, or impair them.
Limitation of Liability
To the maximum extent permitted by law, neither Onmode nor its service providers will be liable for any indirect, incidental, special, exemplary, or consequential damages, or for lost profits, revenues, savings, data, or goodwill, arising out of or relating to these Terms or your use of (or inability to use) the Services, whether based on warranty, contract, tort, or any other theory, even if advised of the possibility of such damages.
We are not liable for any personal injury, health problem, or other damage resulting from use or misuse of the Services or the information they provide, including nutritional information, targets, recipes, and medication reminders. Do not rely solely on the App for health decisions; always seek guidance from a qualified healthcare professional.
To the maximum extent permitted by law, our total liability arising out of or relating to these Terms or the Services will not exceed the greater of the amounts you paid us for the Services in the 12 months before the claim, or one hundred U.S. dollars ($100).
Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory rights as a consumer.
Links to Third-Party Websites
The Services may link to third-party websites and resources. Their presence is not an endorsement, and we are not responsible for their content, safety, or practices, nor for any loss arising from your use of them.
Governing Law and Dispute Resolution
These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of Romania, without regard to conflict-of-law rules. You and Onmode agree to submit to the exclusive jurisdiction of the competent courts of Romania and waive any objection to that venue, except that if you are a consumer, you keep any right to bring proceedings in the courts of the country where you live. Changes to These Terms
We may update these Terms from time to time. The updated version takes effect when posted. For changes that materially alter these Terms, we will provide notice (in the App or by email) at least fifteen (15) days before they take effect, except where a shorter period is required by law or for security or legal reasons. By continuing to use the Services after changes take effect, you accept the updated Terms.
Termination
We may suspend or terminate your access to the Services, including your Account, at our sole discretion, at any time, with or without notice. You may stop using the Services and delete your Account at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, payments owed, governing law, and general terms) will survive.
Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
Rights and Terms for Apple App Store Apps
This section applies to the Onmode app obtained from the Apple App Store. These Terms are between you and Onmode only, not Apple. Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App (including product-liability, legal or regulatory, or consumer-protection claims) or any third-party intellectual-property claim. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in an embargoed country or on any U.S. government restricted-party list, and you will comply with applicable third-party terms when using the App.
General Terms
These Terms are the entire agreement between you and Onmode regarding the Services and supersede prior agreements on that subject. You may not assign these Terms without our prior written consent; we may assign them freely. Our failure to enforce a provision is not a waiver. Notices may be given by email or by posting to the Services; emailed notices are deemed received when sent.
